DECISION:
to determine the following:
REGULATIONS, regulating the presentation of waste at the recycling center to:
- Bay 3 in Gorinchem
- Transportweg 6 in Groot-Ammers
- Schrank 10 in Hardinxveld-Giessendam;
- Handelstraat 15 in Leerdam.
- Sportlaan 4 in Vianen
Chapter 1 - General
Definitions
In these regulations the following terms are understood to mean:

the person who, under the responsibility of the team manager, is responsible for supervising the recycling center. |

the person who, under the responsibility of the manager, is responsible for, among other things, providing services at the gate. |
|
provider |
the person who offers waste at the recycling center. |
| carrier | the person, not employed by the Waardlanden Cleaning Service, who transports containers containing waste materials to locations where these waste materials are processed or transhipped. |
| waste products | any waste, preparation or other product which the holder discards, intends to discard or is required to discard with a view to its disposal. |

Chapter 2 - Provisions applicable to the recycling center
Section 2.1 - Provisions for the provider
Article Waste may only be disposed of at the recycling center if it falls within the scope of the applicable permit under the Environmental Management Act. Furthermore, the requirements set out in these regulations must be met.
Article The waste supplier must be able to show proof of identity and an environmental pass at all times when offering waste.
Article Upon arrival at the recycling center, the provider is obligated to follow these regulations and the instructions provided by the manager or indicated by signs. These instructions must be followed promptly and accurately. The Traffic Rules and Signs Regulations also apply on the site.
Article If these regulations or the instructions by or on behalf of the director, the department manager, the team manager, or the administrator are not followed, they are authorized to deny the provider access to the recycling center.
Article The board, director, department manager, team manager, or administrator may decide to temporarily refuse certain waste materials if circumstances at and around the recycling center warrant it. A refusal form will be drawn up for this purpose. The provider will be notified of the refusal, and the administrator will prepare a report of findings within one week.
If certain waste materials are temporarily not accepted or cannot be accepted, this will be stated on the website. www.waardlanden.nl published.
Article Waste must be collected during the opening hours set by the board, as displayed on the sign at the entrance to the recycling center. Any deviations from the aforementioned opening hours will be communicated in a timely manner through publication in local newspapers and on the website. www.waardlanden.nl, announced.
Article It is prohibited to place or dump waste at or around the recycling center in any place or manner other than as specified in or pursuant to these regulations.
Article The transport and disposal of waste must be carried out in such a way that it does not cause contamination of access roads, the recycling centre or the surrounding area.
Article Method of offering by the provider:
The provider reports to the manager/employee of the recycling center.
The provider is obliged to show their environmental pass and provide information about the waste materials delivered to the manager/employee of the recycling center.
The manager/employee of the recycling center will state any costs.
The provider carries out the financial transaction if applicable.
The recycling center manager/employee will provide instructions to the provider. The provider is obligated to follow these instructions.
Bringing/sorting waste without permission from the manager/employee of the recycling center is prohibited.
Spilled waste must be cleaned up by the provider himself.
After the waste has been dumped, the provider must immediately leave the recycling center with his vehicle.
It is forbidden to take goods that are located at the recycling center with you.
Article Access to the recycling center:
- It is prohibited to be at the recycling center outside the times set by the board.
- Persons under 12 years of age are only permitted at the recycling center in a vehicle. They may not leave the vehicle while waste is being collected.
- Persons other than waste suppliers are not permitted to be present at the recycling center without the permission of the manager.
- It is prohibited to deliver waste with a tractor and/or a combination longer than 9 meters and/or heavier than 3.500 kg.
Article It is prohibited for anyone to offer the following substances at the recycling center:
- Substances which present a hazard through spontaneous combustion, explosion, contamination and/or radiation;
- Substances that emit excessive odors or contain vermin;
- Hot ash;
- Vehicles subject to registration requirements, such as wrecked cars, scooters and parts thereof;
- Asbestos other than described in Article 2.1.13;
- Ground;
- corpses;
- Car tires with rim
- Commercial waste, including commercial white and brown goods.
Article It is for companies and for Non-residents of the Cleaning Service service area are prohibited from offering waste. An exception is made for partners of the circular network who bring deferred household waste and have received an access pass for this purpose.
Article Asbestos and asbestos-containing materials must be presented in the following manner:
- Not more than 35 m2 per quarter;
- Upon submission of the demolition notice;
- Packed in double-sided plastic of at least 0,2 mm thick;
- Masked with waterproof tape;
- Provided with the warning “Caution: dangerous, contains ASBESTOS”.
The plastic and tape will be provided upon request by the Waardlanden Cleaning Service. Asbestos-containing materials may not be packaged in or near the facility.
Article Carcasses will not be accepted and can be offered at the Gorinchem Animal Shelter located at Haarweg 1 in Gorinchem, upon payment of the applicable rate.
Article Small hazardous waste must be delivered to the small hazardous waste depot at the recycling center, or to the chemical waste collection cart that is periodically present at the Leerdam recycling center. The supplier must hand the waste over to the manager. They must also indicate which substances are being offered.
For small hazardous waste whose composition is unknown, the waste will be stored at the provider's expense. This will be recorded in a report of findings. The waste will then be analyzed and, if possible, delivered to a processor. The costs associated with storing, analyzing, and processing the waste are entirely borne by the provider. If the type of waste is still unknown after analysis, the provider must remove their own waste from the recycling center. Storage and analysis are not possible with the chemical waste collection cart at Leerdam recycling center.
Article White and brown goods must be presented in a condition that can reasonably be considered complete. White and brown goods are not required to be in working order. Retailers may request permission from the director to return their customers' white and brown goods to the recycling center free of charge, without prejudice to the provisions of Articles 2.1.11 and 2.1.12.
Article The administrator assesses whether prohibited substances and/or an illegitimate supplier are involved. If a refusal is made, the administrator will complete the refusal form in Appendix 1 and submit it to the supplier. The supplier will acknowledge the refusal, and the administrator will prepare a report of the findings within one week.
Section 2.2 - Provisions for the carrier
Article Outside opening hours, carriers may only be on the premises with the express permission of the team leader and with the knowledge of the manager. When entering or leaving the premises outside opening hours, the access gates must always be closed.
Article 2.2..2 It is prohibited for carriers to sort waste.
Article No containers containing waste may leave the recycling center grounds if the required documents, as prescribed by the government for the transport of waste, are not completed or are incomplete.
Article Upon arrival at the recycling center, the carrier is obliged to follow these regulations and the instructions provided by the manager or indicated by signs.
Article If these regulations or the instructions by or on behalf of the director, the department manager, the team manager, or the administrator are not followed, the director, the department manager, the team manager, and the administrator are authorized to deny the carrier access to the recycling center.
Article Waste materials must be transported in such a way that they do not cause contamination of access roads, the recycling centre or the surrounding area.
Chapter 3 - Liability
Section 2.3
Article The Waardlanden Cleaning Service accepts no liability for the consequences of offering waste other than that permitted under the Environmental Management Act (Wet Milieubeheerwet) for the recycling center and these regulations.
Article The Waardlanden Cleaning Service accepts no liability for the consequences of entering and driving on the grounds of the recycling center.
Article The provider and the carrier are jointly and severally liable for any damage caused by them, their personnel, any persons designated by them, or any equipment used by them, or any waste or other substances they bring to the recycling center staff or to objects in use by third parties.
Article The supplier and the carrier are jointly and severally liable for the costs of removing and/or destroying the substances they offer.
Article The provider and the carrier are jointly and severally liable for the costs of removing and/or destroying any substances they offer that, in the opinion of the director, the department manager for implementation, the team manager, the administrator, or the local, provincial, and/or national government, could cause environmental damage if they were not removed and/or destroyed.
Article The provider and the carrier indemnify Reinigingsdienst Waardlanden against all claims for damages by themselves or by third parties, regardless of the cause of the damage.
Chapter 4 - Denial of Access
Section 2.4
Article The director, department manager, team manager, or administrator is authorized to indefinitely deny access to the recycling center to any provider or carrier who violates the rules set forth in these regulations. The provider or carrier will be notified of the refusal, and the administrator will prepare a report of findings within one week. The provider will be notified of the refusal by the Waardlanden Cleaning Service within one week.
Chapter 5 - Entry into force and repeal
Section 2.5
Article These regulations will enter into force on 1 March 2024, with the simultaneous repeal of the Waardlanden waste disposal site regulations as adopted on 12 December 2019.
Chapter 6 - Final Provision
Section 2.6
Article These regulations may be cited as the “Waardlanden Recycling Center Regulations”.
